Determining a Wrongful Death in California
Wrongful deaths are most frequently caused by someone’s negligence. In many instances, the deceased sustained a fatal injury during an accident, such as a workplace accident or pedestrian accident. Although not every accident-related fatality is deemed a wrongful death, many of them are.
When a person fails to exercise reasonable care to prevent an accident, it can result in severe injury to others. The legal term for this is negligence. When a person’s negligence is the source of another’s death, that death is considered wrongful.
California law permits specific surviving relatives to bring a suit against the negligent business, person, or other entity determined to be responsible for the death of their family member. In order to determine if you have a valid wrongful death case, we encourage you to reach out to an experienced wrongful death lawyer in California.
A wrongful death suit is a civil action wherein some surviving relatives of the deceased are entitled to file a claim against another person or entity whose negligent behavior caused the accident that resulted in the victim’s death.
Wrongful death cases are distinct from criminal proceedings. When fault is established in a wrongful death suit, surviving family members are awarded financial compensation. If your wrongful death case is successful, the liable person or persons will be court-ordered to pay a specific amount of money to the family members who filed the claim. The court will grant economic recovery for their damages which usually includes things such as:
- Medical and hospital bills
- Funeral and burial expenses or cremation expenses
- Emotional anguish
- Lost earnings and lost future earnings
A personal injury lawyer in Los Angeles will be able to help you figure out how your accident happened and whether or not you qualify for financial compensation. They will also help you collect financial compensation, even if you were partially at fault for the crash. Compensation can cover the majority of the costs you face in the aftermath of your accident.
